Judge Says Uncle It isn't incest. It isn't sex with a minor. It could be rape, but the
district attorney is still thinking about it. This must be Kentucky! Tony Gene Wilson, 24, was facing up to 20 years in the slammer on two
counts of incest, stemming from his 16-year-old niece's accusation that
he forced her to have sex with him. His attorney said Kentucky law doesn't
specifically outlaw sex between an uncle and niece, just sex with an "ancestor,
descendant, brother or sister." Because the uncle and niece don't share
a direct blood line, the judge came down on Wilson's side, even though
other Kentucky laws don't let anybody marry anyone who's closer than a
second cousin. And if you're thinking, "Okay, no incest, but how old was she?" In most
of the civilized world, sex with a 16-year-old is still a big no-no, but
this is Kentucky, where 16 is the age of consent. So, you can't marry
your uncle, but you can have sex with him as long as you're over 16? Maybe that's what Wilson was thinking. However, he's still not off the
hook, legally. His niece, now 17, told the court Wilson forced her to
have sex two times with him, and that IS against the law in Kentucky.
The DA is thinking about filing charges, but she won't say for sure. - DailyDarwin.com Staff
